Terms of Service

Last updated: 29 October 2026

The short version

  • Itineraries, prices and timings on this site are a guide. A trip or event is booked only when we confirm it to you and receive the advance.
  • Our packages depend on weather, roads, permits and third-party suppliers, so we may need to adjust a plan. If we cancel a trip before it starts, you get a full refund.
  • An advance is needed to confirm a booking and the amount depends on the package. If you cancel, the advance is not refunded and the balance is refunded only as explained in section 6. Events have their own terms in their brochure.
  • Adventure activities carry real risk. Please read section 10 and take travel insurance.

1. About these terms

These terms apply to your use of openskytravels.in and to any enquiry, registration or booking you make with OpenSky Travels and Events LLP ("OpenSky", "we", "us", trading as OpenSky Travels), a limited liability partnership running a travel and events business at 2nd Floor, Mattam Arcade, Pottammal, Kozhikode, Kerala 673016, India. By using the site or booking with us you agree to them, together with our Privacy Policy. If a package page, brochure or booking confirmation contains a more specific term, the specific term applies to that trip.

When you book, you confirm that you are at least 18 years old and that you accept these terms for yourself and for everyone you book for, and that you have their permission to share their details with us.

2. Using this website

  • Use the site lawfully and for your own enquiries. Do not try to disrupt it, bypass its security, send spam through our forms, or copy its content in bulk with automated tools.
  • Give accurate information in any form you submit.
  • We may change, suspend or remove any part of the site without notice. We try to keep it available but do not promise it will always be error-free or uninterrupted.

3. Packages, itineraries and prices

  • Descriptions, itineraries, photographs and timings on the site and in our brochures are for guidance. Photos are illustrative and may show places, weather or seasons that differ from your dates.
  • Prices are quoted in Indian rupees and depend on your dates, group size, hotel and transport choices. A price shown or discussed is not final until we confirm it in writing (including by WhatsApp or email).
  • Attraction opening times, entry rules, road, pass and tunnel access, and permits are controlled by authorities and may change without notice. Visits listed as "subject to weather" or "subject to availability" are not guaranteed.
  • We take care to keep information accurate but cannot promise it is free of mistakes. If we find an error that affects your booking, we will tell you and offer you the choice of the corrected terms or a refund under section 7.

4. Enquiries, registrations and bookings

  • Sending an enquiry, using a "Book now" or "Register interest" form, or WhatsApping us is a request, not a confirmed booking. Registering interest does not hold a seat.
  • A booking is confirmed only when we confirm it to you in writing and we have received the advance payment. Until then we may decline a request, for example if there are no seats or the group is full.
  • The person who makes the booking is responsible for all travellers named in it and for passing these terms on to them.
  • Names on tickets, passes and hotel records must match the traveller's ID. Name changes may incur supplier charges or may not be possible.

5. Payment

  • An advance is required to confirm a booking. The amount varies by package and is stated in your quote, brochure or booking confirmation. The balance is due before departure, by the date we give you. For last-minute bookings we may ask for full payment at once.
  • You may pay by any method we accept at the time (for example bank transfer, UPI, cash or card). Pay only to the account or UPI details we give you in writing, and ask for a receipt. We are not responsible for money sent to any other person or account. If you are unsure whether a payment request is genuine, call us on a number shown on this site before paying.
  • Prices include or exclude taxes as stated in your quote. Bank, transfer and card charges are borne by the payer.
  • If the balance is not received on time we may treat the booking as cancelled by you under section 6.
  • Items listed under "exclusions" (for example train or flight tickets on some packages, optional activities, personal expenses and additional meals) are not covered by the package price.

6. Cancellation by you and refunds

Most of our costs (hotels, transport, tickets, permits) are committed and paid to suppliers in advance. To cancel, tell us in writing (email or WhatsApp). The date we receive it is the cancellation date.

  • Holiday packages, advance: the advance you paid to confirm the booking is non-refundable.
  • Holiday packages, balance: if you have paid more than the advance, we refund the balance less the costs we have already incurred and cannot recover from hotels, transport and other suppliers, plus a reasonable handling fee. We will tell you the figures in writing. No refund is given where the cancellation reaches us close to departure, because by then these costs cannot be recovered; the cut-off for each package is stated in your quote or brochure.
  • No refund is given if you do not turn up, miss a pick-up, leave early or do not use a service.
  • Events and camps: each event has its own cancellation terms, listed on the event page and in its brochure. Those terms apply to that event.
  • If you cannot travel you may, with our agreement, transfer your place to another person. Supplier charges for changing names may apply.
  • Travel insurance that covers cancellation is strongly recommended. We cannot refund amounts that insurers or third parties decline.
  • This section does not apply when we cancel or change a trip. Section 7 explains what you get in that case.

7. Changes and cancellations by us

  • Itinerary changes. We may change the order of sightseeing, timings, hotels (to ones of similar standard), vehicles or routes because of weather, road or tunnel closures, snowfall, landslides, strikes, traffic, security, supplier failure or safety. We will tell you as soon as practicable and try to offer an alternative of similar value.
  • If we cancel a trip or event before it starts, for any reason, you will receive a full refund of every amount you paid us for it, or, if you prefer, an alternative date or itinerary. Refunds are paid to the original payer within 14 working days. The same applies if we make a significant change you do not accept (for example, dropping the main destination). Unless we are at fault, we are not responsible for further costs such as separate tickets or leave from work.
  • Minimum numbers. Group trips and events need a minimum number of travellers. If it is not met we may cancel or reschedule, and will refund in full what you paid or offer another date.
  • Force majeure. Neither of us is liable for failure or delay caused by events beyond reasonable control, including natural disasters, severe weather, epidemics, war, riots, strikes, government orders, road, rail or airline disruption, and closure of attractions. If this stops a trip before it starts we cancel under the full-refund rule above. If it disrupts a trip that has started, we will adjust the plan and offer alternatives, and will refund the part of the price for included services we could not deliver, to the extent we recover it from suppliers. Extra costs arising (for example an unplanned overnight stay caused by a road closure) are payable by the travellers directly, unless we say otherwise.
  • Removal from a trip. We may remove a traveller whose behaviour endangers others, breaks the law or these terms, or who is unfit to travel, without refund.

8. Your responsibilities as a traveller

  • Carry valid photo ID for every traveller, and any permits, visas or documents the trip needs. You are responsible for having them.
  • Carry enough of your regular medicines, and be honest about your fitness for activities such as trekking at altitude. If your trip's guidelines ask for health information, give it accurately. If something could matter to your safety in an emergency, you can tell your trip coordinator privately.
  • Be on time for pick-ups and activities. We cannot hold the group for latecomers, and missed services are not refunded.
  • Respect other travellers, staff, local people, hotel and resort rules, wildlife and the environment, including local bans on plastic and littering.
  • Illegal substances are strictly prohibited on all our trips, and their use leads to removal from the trip without refund. Whether alcohol is allowed depends on the trip, package, stay and location, so follow the guidelines given for your trip. Breaking those guidelines can also lead to removal without refund.
  • Look after your own belongings. We are not responsible for loss or theft of personal property.
  • Damage you cause to hotel, vehicle or supplier property must be paid for by you.
  • Please buy travel insurance covering medical costs, accidents, cancellation and baggage.

9. Respect, safety and inclusion

Everyone on an OpenSky trip has the right to feel safe and respected.

  • Zero tolerance. Sexual harassment of any kind (including unwelcome comments, messages, touching, staring, photographing someone without consent, or pressure for contact), assault, stalking, bullying, intimidation and discrimination are not allowed, whether towards other travellers, our team, suppliers or local people.
  • Illegal activity. Any illegal activity during a trip is not allowed.
  • What we will do. We will act quickly and take complaints seriously and in confidence. We may remove the person from the trip immediately and without any refund, will report the matter to the police or other authorities where it is a crime or the law requires, and will cooperate fully with any investigation. Travel home from the point of removal is at the person's own cost.
  • How to report. Tell your trip coordinator, or call or WhatsApp us on the numbers at the bottom of this page.
  • Everyone is welcome. We welcome travellers of all genders, sexual orientations, faiths, castes and backgrounds, including LGBTQ+ travellers, and we do not tolerate discrimination. Some events or packages are meant for a particular group, and any eligibility rule is stated on that event or package page. We choose our suppliers with care, but we cannot control every hotel, vehicle or local person's attitude. If you experience discrimination, tell us so we can act.

10. Adventure activities and risk

Travel in the outdoors carries risk. Activities such as skiing, snowboarding, snowmobiles, paragliding, river rafting, boating, trekking, jeep safaris and swimming are optional, are usually run by independent local operators, and are done at your own cost and risk unless the itinerary says they are included. Follow the instructions of operators and guides and the safety rules at each location. Do not take part if you are unwell, under the influence of alcohol or not comfortable, and do not take part for the sake of a photograph. We may cancel or skip an activity if conditions are unsafe, with no refund for activities that are not included in your price.

By travelling with us you accept these risks, which include accidents, illness, injury and, in rare cases, death caused by terrain, altitude, weather, wildlife, water, traffic or the actions of others. To the fullest extent the law allows, you agree not to hold OpenSky responsible for injury, illness or loss that results from these risks and that was not caused by our own negligence. We may ask you to sign an activity waiver or acknowledgement before specific activities. Please buy personal accident and medical insurance that covers the activities you plan to do.

Activity waivers

At our discretion, some activities may require you to read and sign an additional waiver, release or acknowledgement form before you take part. Signing it is a condition of taking part. If you do not sign, or we are not satisfied that you understand the risks or are fit for the activity, we may not allow you to join that activity, and no refund is due for it. Where a form applies, it is in addition to these terms and, to the fullest extent the law allows, releases OpenSky from claims arising from the risks it describes. As in section 12, nothing in it removes liability that cannot lawfully be excluded, such as liability for death or personal injury caused by our own negligence.

Insurance

We may offer, or arrange through licensed insurance partners, optional travel or personal accident insurance for an additional cost shown to you before you book. Insurance is a contract between you and the insurer. Its cover, exclusions, limits and claim process are set by the insurer, and we are not the insurer. If we offer insurance and you decline it, or choose to arrange your own, we may ask you to confirm that in writing. You are then responsible for any medical, evacuation, cancellation or other costs that the insurance would have covered, to the fullest extent permitted by law.

11. Suppliers and third-party services

Hotels, resorts, transport operators, railways, drivers, guides and activity providers are independent businesses and operate under their own terms and rules (for example hotel check-in times and railway or airline fare rules).

  • Services included in your package. We are responsible for choosing these suppliers with reasonable care and for arranging the services as described. If an included service is not delivered as described, we will put it right with an alternative of similar value or, if that is not possible, compensate you for the undelivered part in line with section 7 and the law.
  • Optional extras you book or pay for directly with a local operator (for example adventure activities, shopping or paid add-ons) are provided by that operator under its own terms. For those, the operator is the service provider and we only help you take part.

This site links to third-party websites that we do not control.

12. Our liability

We will provide our services with reasonable care and skill. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under Indian law, including our responsibility for death or personal injury caused by our own negligence, for fraud, or your rights as a consumer under the Consumer Protection Act, 2019.

Subject to that, and to the fullest extent the law allows:

  • we are not liable for loss, injury, illness, death, delay or extra cost caused by other travellers or third parties we do not control, by operators of optional extras you book or pay for directly, by force majeure, by the inherent risks described in section 10, or by your own acts, health, or failure to follow instructions or these terms. For services included in your package, we remain responsible as set out in section 11;
  • we are not liable for indirect or consequential losses such as loss of income, loss of enjoyment beyond what the law requires, or missed connections not booked through us;
  • we are not liable for costs that insurance offered or recommended to you would have covered, if you declined or did not take it; and
  • our total liability to you for a booking is limited to the amount you paid us for that booking.

13. Special terms for events and camps

  • Events and camps have fixed dates, limited seats and may be restricted to a particular group. We may refuse or cancel a registration that does not meet the stated eligibility.
  • Registration closes on the date shown on the event page, or earlier if seats are full or we close it. After that, registration forms on the site and the banners and pop-ups for the event are removed.
  • The dates and the reporting time shown on the event page are fixed unless we tell you otherwise. Programme timings inside the event may change.
  • Event-specific rules, cancellation and refund terms and guidelines on the event page and brochure form part of these terms and prevail for that event.

14. Photos and videos

Our team may take photos and videos on trips and events and may use them to promote OpenSky on the website and social media. If you do not want to appear in them, tell the trip coordinator at the start of the trip or write to us, and we will take reasonable steps to leave you out or remove you from future use.

15. Content and brochures

  • The OpenSky name, logo, text, design and brochures belong to OpenSky Travels or our licensors. You may view them and download a brochure for your personal use in planning a trip, but you may not copy, edit, resell or republish them without our permission.
  • Brochure PDFs are watermarked, protected against editing and shared through links that expire after a short time.
  • Some photographs on the site are licensed from other photographers under Creative Commons or similar licences. Their credits are shown on the relevant pages.

16. Complaints

If something goes wrong during a trip, tell your trip coordinator or us straight away so we can try to fix it on the spot. For a complaint afterwards, please write to info@openskytravels.in as early as possible after the trip ends, with your booking details and what happened. Raising it early helps us check with our suppliers and put things right. We will acknowledge it within 48 hours and aim to resolve it within 30 days. This does not limit your right to approach a consumer forum.

17. Governing law and disputes

These terms are governed by the laws of India. We will first try to resolve any dispute by talking to you. If that fails, the courts at Kozhikode, Kerala have jurisdiction, but this does not take away any right you have as a consumer to approach the consumer commission that has jurisdiction under the Consumer Protection Act, 2019.

18. General

  • We may update these terms. The version published on the site on the date you book applies to your booking, and the latest version applies to your use of the site.
  • If any part of these terms is found to be unenforceable, the rest remains in force.
  • If we do not insist on a term straight away, we have not given it up.
  • These terms, your booking confirmation and the relevant brochure are the whole agreement between us about your trip.

Read our Privacy Policy to see how we handle your personal data.
